These Terms of Service govern Your use of Pawnshop Pal, the mobile application provided by Alpha Pawn Systems LLC, doing business as Apex Pawn, 625 E 9th St, Mountain Home, AR 72653 ("the Company", "We", "Us", or "Our"). By using Pawnshop Pal, You agree to these Terms. Our Privacy Policy describes how We handle Your information.
Pawnshop Pal lets You view information that pawn shops using Our software keep about You, such as Your loans, buys, purchases, and due dates, and exchange messages with those pawn shops.
Each pawn shop is an independent business that We do not own or operate. Your loans, buys, sales, and other business with a pawn shop are governed by Your agreements with that pawn shop, not by these Terms. The information shown in Pawnshop Pal comes from the pawn shop's records. If it differs from Your pawn ticket or receipt, or You believe it is wrong, contact the pawn shop.
You must be at least 18 years old to use Pawnshop Pal.
You sign in to Pawnshop Pal with an email address or a phone number. Keep access to it secure, and do not share Your sign-in codes with anyone. You are responsible for activity on Your Account. Do not sign in as anyone else or try to view another person's customer accounts.
Pawnshop Pal sends two kinds of text messages:
We do not send marketing text messages. Agreeing to receive texts is optional. Declining does not affect Your business with any pawn shop: Your loans, buys, sales, or anything else. You can sign in with an email address instead.
Message and data rates may apply. Reply STOP to any message to opt out; You may receive one message confirming that You have opted out, and You will receive no further texts from Us unless You reply START. Reply HELP for help, or email support@apexpawn.com. Carriers are not liable for delayed or undelivered messages.
We do not share or sell Your mobile phone number or Your consent to receive text messages with any third party or affiliate for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text message services.
Messages You exchange with a pawn shop become part of that pawn shop's records. Do not send messages that are unlawful, threatening, or abusive. Pawn shops decide whether and how to respond to messages.
Do not misuse Pawnshop Pal. That includes interfering with its operation, attempting to access data You are not authorized to see, copying or reverse engineering the Application except as the law allows, or using it for any unlawful purpose.
You can stop using Pawnshop Pal and delete Your Account at any time, as described in Our Privacy Policy. We may suspend or close Your Account if You violate these Terms or if needed to protect the Service, pawn shops, or other users.
Pawnshop Pal is provided "as is" and "as available". To the extent the law allows, We make no warranties, express or implied, including that the Application will be uninterrupted or error-free or that the information it shows is complete, accurate, or current.
To the extent the law allows, the Company will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from Your use of Pawnshop Pal, and Our total liability for any claim relating to Pawnshop Pal will not exceed one hundred US dollars.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
We may update these Terms from time to time. We will post the new Terms on this page, let You know through a prominent notice in the Application before the change becomes effective, and update the "Last updated" date at the top of these Terms.
